These Terms of Service ("Terms") govern your access to and use of QuerySure AgentOS and related services provided by QuerySure Technologies ("QuerySure", "we", "us", or "our").

By accessing or using the Services, you agree to be bound by these Terms.

1. Definitions

  • "Services" means the QuerySure website, AgentOS platform, applications, APIs, integrations, AI-powered features, and related services.
  • "User" means any individual or organization accessing or using the Services.
  • "Customer Data" means all information, documents, records, files, and content uploaded, submitted, or processed through the Services.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding agreements to use the Services.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Nature of Services

QuerySure is a software and technology platform.

QuerySure does not act as:

  • An insurance company
  • Insurance broker
  • Insurance agent
  • Insurance intermediary
  • Financial advisor
  • Legal advisor
  • Tax advisor

The Services are provided solely as technology tools to assist users with operational workflows.

Users remain solely responsible for all business, insurance, compliance, underwriting, servicing, customer-facing, and regulatory decisions.

4. Account Responsibilities

Users are responsible for:

  • Maintaining account security
  • Protecting login credentials
  • Managing user access permissions
  • Ensuring authorized use of the Services

You are responsible for all activity occurring under your account.

You must immediately notify QuerySure of any unauthorized access or security incident.

5. Customer Data

You retain ownership of all Customer Data uploaded to the Services.

You grant QuerySure a limited, non-exclusive license to process Customer Data solely for:

  • Operating the Services
  • Providing requested functionality
  • Maintaining security
  • Performing support and maintenance activities

QuerySure does not claim ownership of Customer Data.

6. User Responsibilities

You represent and warrant that:

  • You have all necessary rights to upload Customer Data.
  • Customer Data has been lawfully obtained.
  • Required consents have been obtained.
  • Your use of the Services complies with applicable laws and regulations.

You are solely responsible for the accuracy, legality, and content of Customer Data.

7. AI Features

The Services may use artificial intelligence and machine learning technologies.

You acknowledge that:

  • AI-generated outputs may contain errors, inaccuracies, omissions, or incorrect interpretations.
  • AI outputs are provided for assistance purposes only.
  • AI outputs do not constitute insurance, financial, legal, regulatory, or professional advice.
  • Users must independently verify all AI-generated outputs before relying on them.

QuerySure does not guarantee the accuracy or completeness of AI-generated results.

8. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes.
  • Upload malicious software or harmful content.
  • Attempt to gain unauthorized access to systems or accounts.
  • Interfere with platform operations.
  • Reverse engineer, copy, or exploit the Services beyond permitted use.
  • Use the Services to violate privacy, intellectual property, or regulatory obligations.

QuerySure may suspend or terminate accounts that violate these Terms.

9. Subscription, Billing, and Payments

Certain Services may require payment of subscription fees, setup fees, or other charges.

Users agree to pay all applicable fees.

Failure to pay may result in:

  • Account suspension
  • Restricted access
  • Service termination

Fees are non-refundable except where required by law or expressly stated in a separate Refund Policy.

10. Service Availability

While QuerySure strives to maintain reliable Services, we do not guarantee:

  • Uninterrupted availability
  • Error-free operation
  • Continuous uptime
  • Compatibility with all third-party systems

Scheduled maintenance, updates, outages, or external service disruptions may affect availability.

11. Third-Party Services

The Services may integrate with or rely upon third-party providers, including:

  • Cloud infrastructure providers
  • Payment processors
  • Authentication services
  • AI service providers

QuerySure is not responsible for the availability, performance, security, or actions of third-party services.

12. Intellectual Property

All rights, title, and interest in the Services, including software, branding, documentation, designs, content, and technology, remain the exclusive property of QuerySure Technologies.

These Terms do not grant ownership of any intellectual property rights.

Users may not:

  • Copy
  • Modify
  • Resell
  • Distribute
  • Reverse engineer

the Services except as expressly permitted by law.

13. Confidentiality

Each party agrees to protect confidential information received from the other party and use it only for purposes related to the Services.

This obligation survives termination of the relationship.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUERYSURE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy
  • Reliability

QuerySure does not guarantee that the services will be error-free or uninterrupted.

15. Limitation of Liability

To the maximum extent permitted by law, QuerySure shall not be liable for:

  • Indirect damages
  • Incidental damages
  • Special damages
  • Consequential damages
  • Loss of profits
  • Loss of business
  • Loss of data
  • Loss of revenue
  • Regulatory penalties
  • Customer claims

Arising from or related to use of the services.

In no event shall QuerySure's total liability exceed the amount paid by the user to QuerySure during the twelve (12) months preceding the event giving rise to the claim.

16. Indemnification

You agree to defend, indemnify, and hold harmless QuerySure Technologies, its directors, employees, contractors, and affiliates from any claims, damages, liabilities, penalties, losses, or expenses arising from:

  • Your use of the Services
  • Customer Data uploaded by you
  • Violation of these Terms
  • Violation of applicable laws
  • Claims made by third parties

17. Suspension and Termination

QuerySure may suspend or terminate access to the Services if:

  • These Terms are violated
  • Fees remain unpaid
  • Security risks are identified
  • Required by law

Upon termination, access to the Services may be discontinued.

Customer Data retention and deletion will be governed by the Privacy Policy.

18. Changes to the Services

QuerySure may modify, improve, discontinue, or replace features of the Services at any time without liability.

19. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted on our website with a revised effective date.

Continued use of the Services constitutes acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
